Zoning lawsuit

Three Missoula City Council members filed it against the city, according to this news release. It quotes Councilors Renee Mitchell, Dick Haines and Lyn Hellegaard. Reporter Bill Schwanke is posting the actual lawsuit to Missoulian.com so check that soon — and I’ll link to it too when it’s live.

Are they asking for an injunction? I’d like to continue discussing the merits of various substantive issues with the CC while the lawsuit is figured out.

    Ugh… my head hurts now.

Something similar to an injunction. The city has not yet been served.

I think we can continue the hearings. I’m just happy there was no cease and desist portion of the request. Phew…

Wait… scratch that. “…cease proceedings…” Ugh, my head hurts again.

Is that “cease proceedings” … as in, until after the City Council elections?

If I were reporting this story, the first two calls I would make would be to Councilmen Hendrickson and Wilkins asking why they filed for reelection, signed a guest editorial in the Missoulian making the same claim this lawsuit does (that the Title 20 process is illegal), and then didn’t join it. Councilman Haines is also up for reelection and he seems to have the courage of his convictions. Why don’t the other two?
