Sonata Park not a walk in the park
The Missoula City Council lost this lawsuit, too, but Mayor John Engen said this week the city will appeal the decision.
Heidi Kendall forwarded an electronic copy of the opinion on the Sonata Park lawsuit.
The ruling raises some questions. It seems to give a neighborhood plan the weight of zoning when it comes to density.

Read on. And as Kendall noted earlier, the court again describes a council decision as “arbitrary and capricious.” It’s also quite a different case.

What took the City so long to advise the public that this decision had been made?

It’s not standard practice for them to announce the outcome of lawsuits — win or lose.

Well it should be. So give me a good reason why they don’t.
